The 3rd Pan-African Ethics Human Rights and Medical Law (3rd EHRML) conference was held in Johannesburg on July 7, 2013, as part of the Africa Health Congress. The conference brought together bioethicists, researchers and scholars from South Africa, Zimbabwe, Kenya and Nigeria working in the field of bioethics as well as students and healthcare workers interested in learning about ethical issues confronting the African continent. The conference which ran with a theme of "Bioethical and legal perspectives in biomedical research and (...) medical practice in Africa with a focus on: Informed consent, HIV-AIDS & Tuberculosis, leadership & organizational ethics, patients and healthcare workers rights," was designed to expand the dialogue on African bioethics beyond the traditional focus on research ethics and the ethical dilemmas surrounding the conduct of biomedical research in developing countries. This introductory article highlights some of areas of focus at the conference including issues of leadership, organizational ethics and patients and healthcare workers rights in Africa. We analyze the importance of free speech, public debate of issues, argumentation and the need to introduce the teaching and learning of ethics to students in Africa in accordance with UNESCO guidelines. This article also focuses on other challenges confronting Africa today from an ethical standpoint, including the issues of poor leadership and organizational ethics which are main contributors to the problems prevalent in African countries, such as poverty, poor education and healthcare delivery systems, terrorism, social inequities, infrastructural deficits and other forms of 'structural violence' confronting vulnerable African communities. We believe that each of the eight articles included in this supplement, which have been rigorously peer-reviewed are a good example of current research on bioethics in Africa, and explore some new directions towards broadening the African bioethics agenda as we move forward to a new dawn for Africa in the 21st century. BackgroundThe issue of stigma is very important in the battle against HIV/aids in Africa since it may affect patient attendance at healthcare centres for obtaining antiretroviral medications and regular medical check-ups. Stigmatization creates an unnecessary culture of secrecy and silence based on ignorance and fear of victimization. This study was designed to determine if there is external stigmatization of people living with HIV and AIDS by health care workers at a tertiary hospital in KwaZulu-Natal province, South Africa. The study investigated (...) the impact of knowledge of HIV/aids by HCWs on treatment of patients, as well as the comfort level and attitude of HCWs when rendering care to PLWHA.MethodsA descriptive cross sectional study was designed to collect data using an anonymous self-administered structured questionnaire from 334 HCWs. The study was conducted in clinical departments of a large multidisciplinary 922-bed tertiary care teaching hospital in Durban, KZN.ResultsOverall HCWs had an above average knowledge about HIV/aids although some gaps in knowledge were identified. Tests of statistical significance showed that there was association between level of education and knowledge of HIV/aids ; occupation and knowledge of HIV/aids ; and gender and knowledge of HIV/aids. Test for comfort level was only significant for gender, with males showing more comfort and empathy when dealing with PLWHA. The study also revealed that patients were sometimes tested for HIV without informed consent before surgery, due to fear of being infected, and there was some gossiping about patients' HIV status by HCWs, thereby compromising patient confidentiality. The majority of HCWs showed a willingness to report incidents of stigmatization and discrimination to higher authorities, for better monitoring and control.ConclusionsAlthough knowledge, attitude and comfort level of HCWs taking care of PLWHA was above average, enforcement of existing antidiscrimination laws and continuing education in medical ethics and healthcare law, would greatly improve the performance of HCWs taking care of PLWHAs. More psychological support and counselling should be provided to HCWs, to further reduce the impact of stigmatization and discrimination against PLWHA. (shrink)

Risk management of nanotechnology is challenged by the enormous uncertainties about the risks, benefits, properties, and future direction of nanotechnology applications. Because of these uncertainties, traditional risk management principles such as acceptable risk, cost–benefit analysis, and feasibility are unworkable, as is the newest risk management principle, the precautionary principle. Yet, simply waiting for these uncertainties to be resolved before undertaking risk management efforts would not be prudent, in part because of the growing public concerns about nanotechnology driven by risk perception (...) heuristics such as affect and availability. A more reflexive, incremental, and cooperative risk management approach is required, which not only will help manage emerging risks from nanotechnology applications, but will also create a new risk management model for managing future emerging technologies. Epistemic interactivism, an aspect of the epistemology of representation, is a cognitive intercourse between the subject and person-object of knowledge that underlies the conception of a person in Esan thought. Traditional theories of representation (especially as presented by Descartes and Locke) separated the subject from the object of knowledge, and classified persons and non-persons as object of knowledge. This separation and classification ignored the cognitive and moral values of persons, disengaged the subject from the world and burden the self with (...) solitude and isolation, and created propositional knowledge that dehumanised the relationship between the subject and person-object of knowledge. Within the theoretical framework of Hegel's epistemic interactivism (meliorated by Bowne's personalism) and Esan epistemology (in African philosophy), this book exposes the epistemic interactivism of Esan thought which unified the subject and person-object of knowledge on cognitive and moral grounds; thus providing adequate basis for personhood and resolving the dehumanised relationship between the subject and person-object of knowledge in the traditional theories of representation. Within the context of epistemic injustices, this book analyses the interactivist epistemology of indigenous Esan thought as an alternative epistemological conception of the person-object of knowledge which resolves the deficiency of the traditional theories of representation. A considerable amount of academic attention has been paid to John Kennedy and to his group of advisors during the Cuban missile crisis. Next to no attention has been accorded other bodies of the Kennedy White House that had daily access to a President's most private moments and possibly to his important deliberations. Drawing on Richard Reeves' account of President Kennedy: Profile of Power, I revisit the early 1960s looking for bodies of power that are culturally sexed female by others (...) and compelled into being as workaday secretaries and confidants, and para-Everythings for Kennedy. In doing so, I draw on the feminist body theorizing of Judith Butler, Rosi Braidotti and Elizabeth Grosz, as well as the evocations of bodies in important but abjected places featured in Margaret Atwood's Handmaid's Tale. After constructing the historically broad category of the handmaid to Washington power, I reread constructions of decision-making in the Cuban missile crisis offered by Graham Allison and conclude that the feint of mancentred Washington masks bodies given the locations, skills and resources to ooze into spaces of decision and power canonically forbidden to them. There is much we do not know about nanotechnology. Despite its tremendous promise, nanotechnology today is mostly forecast and fervent hope. Predictions that spending on nanotechnology will increase from current levels of $13 billion to more than $1 trillion by 2015 are no more than that – simply predictions. Hopes that nanotechnology will be an essential part of solving the globe's energy, food, and water problems should be tempered by recalling a century of revolutionary technologies that failed to live up (...) to their early promise such as nuclear energy, supersonic airplanes, or gene therapy. Many other questions continue to nip at nanotechnology's heels, not the least of which are debates about what is and is not technically feasible. Despite these uncertainties, we can have complete confidence in one aspect of nanotechnology's future – it will be subject to a host of regulations. (shrink)

This collection explores the concepts and practices of masquerade as they apply to concepts and practices of war. The contributors insist that masquerades are everyday aspects of the politics, praxis, and experiences of war, while also discovering that finding masquerades and tracing how they work with war is hardly simple. With a range of theories, innovative methodologies, and contextual binoculars, masquerade emerges as a layered and complex phenomenon. It can appear as state deception, lie, or camouflage, as in the population-centric (...) American warfare in Iraq that was sold as good for the local people, or the hidden violence Russian military forces used on each other and on local men in Chechnya. Masquerade can also be part of a people's war logic as exemplified by the Maoist movement in India. Yet masquerade can also be understood as a normal social mask that people don to foreground an identity or belief from one's cluttered repertoire in order to gain agency. Elements of masquerade can appear in texts that proclaim seemingly unequivocal positions while simultaneously yet subtly suggesting opposing positions. Masquerades of all kinds also seem ubiquitous in fieldwork research and in resistance movements in war zones. Perhaps masquerade, though, is ultimately the denial of death lurking behind the clarion call of security, a call that bolsters war by making militarized policing normal to secure populations from terrorists. These interpretations and others comprise Masquerades of War. This book will be of much interest to students of critical war studies, critical security, conflict studies and IR in general. (shrink)

Recent Darwin scholarship has provided grounds for recognising the Origin as a literary as well as a scientific achievement. While Darwin was an acute observer, a gifted experimentalist and indefatigable theorist, this essay argues that it was also crucial to his impact that the Origin transcended the putative divide between the scientific and the literary. Analysis of Darwin’s development as a writer between his journal-keeping on HMS Beagle and his construction of the Origin argues the latter draws on the pattern (...) of the Romantic or Kantian sublime. The Origin repeatedly uses strategies which challenge the natural-theological appeal to the imagination in conceiving nature. Darwin’s sublime coaches the Origin’s readers into a position from which to envision nature that reduces and contains its otherwise overwhelming complexity. As such, it was Darwin’s literary achievement that enabled him to fashion a new ‘habit of looking at things in a given way’ that is the centrepiece of the scientific revolution bearing his name. The proliferation, globalization, and fragmentation of law in world politics have fostered an attempt to re-integrate International Law and International Relations scholarship, but so far the contribution of realist theory to this interdisciplinary perspective has been meagre. Combining intellectual history, the jurisprudence of IL and IR theory, this article provides an analysis of John H. Herz’s classical realism and its perspective on international law. In retrieving this vision, the article emphasizes the political and intellectual context from which Herz’s realism developed: (...) the study of public law in Germany during the interwar period and in particular the contribution of Hans Kelsen and the pure theory of law to the study of international law. Herz was deeply inspired by Kelsen but he criticized the pure theory for ignoring the sociological foundations of law. Following his emigration to the United States, Herz embraced realism but without disregarding international law. Indeed, his mature, globally oriented realism offers a balanced, fruitful perspective for thinking about the relationship between politics and law that is deeply relevant for contemporary theory: it challenges modern, law-blind variants of realism and holds considerable potential for contributing to the approaches that have most successfully studied the law–politics nexus. Nanotechnology is the latest in a growing list of emerging technologies that includes nuclear technologies, genetics, reproductive biology, biotechnology, information technology, robotics, communication technologies, surveillance technologies, synthetic biology, and neuroscience. As was the case for many of the technologies that came before, a key question facing nanotechnology is what type of regulatory oversight is appropriate for this emerging technology. As two of us wrote several years ago, the question facing nanotechnology is not whether it will be regulated, but when and (...) how.Yet, appropriate regulation of nanotechnology will be challenging. The term “nanotechnology” incorporates a broad, diverse range of materials, technologies, and products, with an even greater spectrum of potential risks and benefits. This technology slashes across the jurisdiction of many existing regulatory statutes and regulatory agencies, and does so across the globe. Nanotechnology is developing at an enormously rapid rate, perhaps surpassing the capability of any potential regulatory framework to keep pace. Finally, the risks of nanotechnology remain largely unknown, both because of the multitude of variations in the technology and because of the limited applicability of traditional toxicological approaches such as structure-activity relationship to nanotechnology products. BackgroundThe Western-European concept of libertarian rights-based autonomy, which advocates respect for individual rights, may conflict with African cultural values and norms. African communitarian ethics focuses on the interests of the collective whole or community, rather than rugged individualism. Hence collective decision-making processes take precedence over individual autonomy or consent. This apparent conflict may impact informed consent practice during biomedical research in African communities and may hinder ethical principlism in African bioethics. This study explored African biomedical researchers' perspectives regarding informed consent (...) and potential limitations to the principle of respect for autonomy in African communities.MethodsWe conducted a qualitative study based on in-depth interviews with 12 biomedical researchers, five females and seven males aged 34 to 74 years, currently working at an African university. Interviews lasted 35–40 min each and involved semi-structured open-ended interviews, which allowed participants to offer information about their perceptions and feelings regarding respect for autonomy and informed consent as practised in Africa. Empirical data from the interviews were recorded, transcribed, and analysed using thematic content analysis, together with an interrogation of relevant scientific literature about African communitarian ethics, making evaluations and drawing inferences consistent with the empirical bioethics approach.ResultsBased on these interviews and analysis of relevant literature, we found that informed consent is difficult to apply in an African context because it derives from a Western conception of libertarian rights-based autonomy. Most respondents pointed out that it was challenging to implement informed consent in the African setting. Furthermore, communalism, customary beliefs, spirituality, and relational autonomy are predominant in most African communities, as exemplified by the African moral philosophies of Ubuntu/botho and Ukama, which emphasize communitarianism over individual rights. We also found that language, education, poverty, and cultural beliefs are barriers to obtaining proper informed consent in African communities.ConclusionsWe conclude that there are limitations to applying the principle of respect for autonomy and informed consent in African communities, especially in the context of human biomedical research. We recommend using a more relational approach, such as Ross’s prima facie duties, to implement informed consent in African communities. (shrink)

Bitter and unhappy with their treatment since joining the French-speaking part, many citizens of the minority English-speaking part feel fed up and desire a breakup. I show that apart from constituting an aspect of its pride, Cameroon's history is also a source of tricky (...) challenges the country has been wrestling with since inception. I contend that issues of this kind will always be around if those in the country's cockpit fly it to a destination other than what satisfies and respects the two people – especially the one that moved the English-speaking part to opt for a joint destiny. Instead of toying with truth to score personal political points, authorities should yield to truth, operating in good faith to correct errors and heal hurt hearts so that both people will willingly, not by force, accept to work together. Contrary actions will risk the future. Happiness moves people to look at their history with pride finding things to build while pain stirs frustration and fury, moving them to search for flaws to fix or fight. I hold that both parts face almost the same challenges from unmet needs to emaciating struggles of survival. However, the English-speaking part has unique plaques that ache terribly and have nothing to do with the country’s general cry of lagging development. They touch on its identity and survival, unleashing pain many out of its shoes might fail to feel and so unable to understand the degree of excruciation. I caution that though it has been a show of two regions, the likelihood of someday evolving into a ten-region revolution is certain if wise and inclusive actions are not applied. Apart from groaning in their own pain, many among the other eight are sympathetic to the predicament of the lamenting two, expressing fury, first, against the denial by highly placed authorities of the existence of any problem, and second, in their ruthless and brutal treatment of those who complain or challenge their stance. Anger increased as people's patience waned. Their calm will not last if things stay unchanged. When arguments evolve and accommodate their worries they will get on board pushing the heat to levels officials will have problems containing without facing the temptation of fighting the people they are in office to protect. I end with recommendations the state and activists might find useful. They highlight measures that can help in a heterogeneous society like Cameroon to preserve peace and save it from becoming a scene of mayhem and butchery. (shrink)

The Covid-19 pandemic has compounded the global food insecurity crisis, disproportionately affecting the consumers, farmers, and food workers. The significant disruptions caused by Covid-19 have called international attention to food security and sparked conversations about how to better support food production and trade. Our paper contributes to a small but growing literature on the impacts and responses of agroecological farmers to Covid-19 in Costa Rica. Specifically, we interviewed 30 agroecological farmers about livelihood disruptions during Covid-19, the areas of food production (...) and sales most affected during this pandemic, and how farmers and consumers are adapting during this crisis. Our findings reveal multiple impacts on agroecological farmers including: economic hardships of lower incomes and inability to pay loans, changes in purchasing and consumption patterns, market disruptions, changes in sales, a decrease in agrotourism, and a shortage of farmworkers. Furthermore, we also report the following farmer adaptation strategies: minimizing distance with consumers to facilitate direct delivery, establishing e-commerce platforms. Based on our findings, we recommend the following: building farmer networks for knowledge sharing, increasing technological support for farmers, and providing government support to ensure that such crises do not increase unemployment among farmers and exacerbate food insecurity. This book evaluates the major debates around which the discipline of international relations has developed in the light of contemporary feminist theories. The three debates (realist versus idealist, scientific versus traditional, modernist versus postmodernist) have been subject to feminist theorising since the earliest days of known feminist activities, with the current emphasis on feminist, empiricist standpoint and postmodernist ways of knowing. Christine Sylvester shows how feminist theorising could have affected our understanding of international relations had it been included in (...) the three debates. She elaborates a feminist method of empathetically cooperative conversation which challenges the identity politics of IR, and illustrates that method with reference to the Greenham Common Women's Peace Camp and the efforts of Zimbabwean women to negotiate international funding for their local producer cooperatives. As part of the social distancing measures for preventing the spread of COVID-19, many university courses were moved online. There is an assumption that online teaching limits opportunities for fostering interpersonal relationships and students’ satisfaction of the basic need for relatedness – reflected by experiencing meaningful interpersonal connections and belonging – which are considered important prerequisites for student motivation and vitality. In educational settings, an important factor affecting students’ relatedness satisfaction is the teachers’ behavior. Although research suggests that relatedness satisfaction (...) may be impaired in online education settings, to date no study has assessed how university lecturers’ relatedness support might be associated with student relatedness satisfaction and therefore, student motivation and vitality. This study tested this mediating relationship using data collected during the early days of the COVID-19 pandemic. The study also investigated whether the relations were moderated by a high affiliation motive which reflects a dispositional wish for positive and warm relationships. The possible importance of the communication channel selected by the lecturers and the format of a class were also investigated. In a sample of N = 337 students, we tested our hypotheses using structural equation model. Results confirmed mediation, but not moderation. The use of video chat seems to facilitate the provision of relatedness support but our data did not show that the format of a class was associated with relatedness. Our findings indicate that both teaching behavior and the technical format used to deliver lectures play important roles in student experiences with online classes. The results are discussed in light of other research conducted during the pandemic. (shrink)

To learn whether criticism and regulation of research practices have been followed by a reduction of deception or use of more acceptable approaches to deception, the contents of all 1969, 1978, 1986, and 1992 issues of the Journal of Personality and Social Psychology were examined. Deception research was coded according to type of (non)informing (e.g., false informing, consent to deception, no informing), possible harmfulness of deception employed (e.g., powerfulness of induction, morality of the behavior induced, privacy of behavior), method of (...) deception (e.g., bogus device or role, false purpose of study, false feedback), and debriefing employed. Use of confederates has been partly replaced by uses of computers. "Consent" with false informing declined after 1969, then rose in 1992. Changes in the topics studied (e.g., attribution, socialization, personality) largely accounted for the decline in deception in 1978 and 1986. More attention needs to be given to ways of respecting subjects' autonomy, to appropriate debriefing and desensitizing, and to selecting the most valid and least objectionable deception methods. This article addresses the ability of Parallel Distributed Processing (PDP) networks to generate stagewise cognitive development in accordance with Piaget's theory of cognitive epigenesis. We carried out a replication study of the simulation experiments by McClelland (1989) and McClelland and Jenkins (1991) in which a PDP network learns to solve balance scale problems. In objective tests motivated from catastrophe theory, a mathematical theory of transitions in epigenetical systems, no evidence for stage transitions in network performance was found. It is concluded (...) that PDP networks lack the ability to recover the positive outcomes of analogous catastrophe analyses of real cognitive developmental data. In an attempt to further characterize the learning behaviour of PDP networks, we carried out a second simulation study using the discrimination‐shift paradigm. The results thus obtained indicate that PDP learning is compatible with the learning of stimulus‐response relationships, not with the acquisition of mediating rules such as conceived in (neo‐)Piagetian theory. In closing, we speculate about the feasibility of simulating stagewise development with alternative network architectures. (shrink)

Modern neurotechnologies are rapidly infringing on conventional notions of human dignity and they are challenging what it means to be human. This article is a survey analysis of the future of the digital age, reflecting primarily on the effects of neurotechnology that violate universal human rights to dignity, self-determination, and privacy. In particular, this article focuses on neuromarketing to critically assess potentially negative social ramifications of under-regulated neurotechnological application. Possible solutions are critically evaluated, including the human rights claim to the (...) ‘right to mental privacy’ and the suggestion of a new human right based on spiritual jurisdiction, where the human psyche is a legal space in a substantive legal setting. This article is intended to guide online course developers and teachers. A brief review of the literature on the misconceptions of beginning online teachers reveals that most accept the notion that putting one’s lecture notes online produces effective learning, or that technology will make education more convenient and cost-effective for all concerned. Effective online learning requires a high level of responsibility for learning on the part of students and a reduction of the teacher-student power differential. This, in turn, has major (...) implications for faculty and course development, student selection criteria, the cost of instruction, and the outcomes of education. Effective online teaching focuses on processes of learning rather than outcomes, and is consistent with modern principles of learning that emphasize focusing on issues of high interest to learners, teaching students to use skills of active and effective learning, providing prompt feedback, and enabling students to establish learning goals and employ alternative paths to achieving those goals. Multiple ways of operationalizing these goals online are presented. This article addresses the ability of Parallel Distributed Processing (PDP) networks to generate stagewise cognitive development in accordance with Piaget's theory of cognitive epigenesis. We carried out a replication study of the simulation experiments by McClelland (1989) and McClelland and Jenkins (1991) in which a PDP network learns to solve balance scale problems. In objective tests motivated from catastrophe theory, a mathematical theory of transitions in epigenetical systems, no evidence for stage transitions in network performance was found. It is concluded (...) that PDP networks lack the ability to recover the positive outcomes of analogous catastrophe analyses of real cognitive developmental data. In an attempt to further characterize the learning behaviour of PDP networks, we carried out a second simulation study using the discrimination‐shift paradigm. The results thus obtained indicate that PDP learning is compatible with the learning of stimulus‐response relationships, not with the acquisition of mediating rules such as conceived in (neo‐)Piagetian theory. In closing, we speculate about the feasibility of simulating stagewise development with alternative network architectures. (shrink)

The practical politician must not claim, in the event of a dispute with a theorist, to detect some danger to the nation in those views that the political theorist expresses openly and without ulterior motive.... By this clausula salvatoria, the author ofthis essay will regard himselfto be expressly protected in the best way possible from all malicious interpretation. (Immanuel Kant, Preface to Perpetual Peace) My goal is to work my way back to Kant's defensive preface to Perpetual Peace, the prophetic essay situated by many at the origin ofmodern conceptions ofpeace and international diplomacy. Suffice it to say for the moment that the following reflections are intended to reveal the epitaph in Kant's epigraph—the eternal repose residing in perpetual peace. Imagining relation One of the master ideas to come down to us from the eighteenth century holds that the imagination is central to all relations between self and other, however one might designate this otherness. The imagination is central to Adam Smith's idea of sympathy, and Kant uses it as a bridge to 86Tobin Siebers unify his critical philosophy. Whether referring to objects or other people, we require a faculty by which to extend understanding to them, and this faculty continues even today to be described as imaginative. Postmodern theorists, for example, conceive of human relations in terms of identity politics, but at the core of identification is the power to imagine, be it the power to sympathize or to conceive of a party different from oneself. In effect, then, relation is itself a function of the imagination. Moreover, no relation, I want to claim, exists for long that cannot be well imagined, for which some symbolic object or idea cannot be found. The four dominant modes of relation are religion, aesthetics, ethics, and politics.1 They deserve to be called modes insofar as they name different others to which the self (or another principal) may relate imaginatively. Religion is about the relation of goodness between subject and god called the sublime. Often nature, fate, or providence as personified forces or overarching systems are also called sublime. Aesthetics is about the relation of goodness between subject and object called beauty. Ethics is about the relation of goodness between subjects called character or virtue. Finally, politics is about the relation ofgoodness between communities called peace. Peace may seem at first glance to be an odd choice to name the relation of goodness in politics. A more obvious candidate might be the idea of utopia. But utopia comes into being as a concept only with Thomas More's treatise in 1516, and this late invention seems to exclude its being considered as the privileged good of politics. Moreover, the traditional opposition between ethics and politics exposes the unfitness ofutopia as a candidate for the political good. Ethics and politics are often at war because ethics does not want to sacrifice even one person to improve the relations among other people. Ethics strives for a wholly inclusive community, but it defines this community as a collection of autonomous individuals having value in themselves only as ends and never as means to an end. If ethics aims at a wholly inclusive community of individuals, then "utopia" may be described by rights as an ethical concept, regardless ofthe fact that Utopian desire seems to stress the wrong perspective on this community, coming as it does from the collective rather than the individual point of view. The federal regulations of human research were written to permit the use of discretion so that research can fit the circumstances under which it is conducted. For example, the researcher and institutional review board could waive or alter some informed consent elements if they deem this the morally and scientifically best way to conduct the research. To do so, however, researchers and IRBs would first have to use mature moral and scientific judgment. They might also have to rely on empirical (...) research to discover the most effective way to act on their moral sense. On discovering the most ethical way to proceed, they would then need to look to the federal regulations of human research to discover how to document their decision and justify it within that somewhat flexible regulatory structure. Unfortunately, many IRBs and researchers fail to take these sensible steps to solve ethical problems and proceed immediately to a default requirement of the regulations that places science at odds with the regulations and, ostensibly, with ethics. The following articles in this special issue are about the process of learning to engage in ethical problem solving and using the flexibility permitted by the federal regulations. These articles extricate researchers from the mindset that has gotten them into trouble, and, ideally, provoke them to use mature common sense and moral judgment. (shrink)

This article arises out of critical contemplation of ‘skills’ in relation to Higher Education pedagogy as it relates to the Arts, Humanities and Social Sciences. As the emphasis on skills dominates more and more of the discourse about pedagogy in Higher Education, the article aims to make some critical comments about the reductionist approach to education that easily becomes part of skills discourse. In addition to criticising instrumentalist deployment of ‘skills’ in Higher Education policy, the article also considers the supposedly (...) most ‘radical’ perspective on the idea of skill which is implicit in enactivists’ accounts of the embedding of sensorimotor action in cognition. It is argued that such a perspective is undermined by its insistence on a model of direct human-environment interaction which brackets creativity, anticipation and the future. The article suggests that such a perspective would be illumined by dialogue with Ernst Bloch’s concept of the ‘not-yet’. (shrink)

Psychopower has manifested, and its implementation has changed the way one understands biopolitics. This discussion note references Byung-Chul Han’s interpretation of modern psychopolitics to investigate whether basic human rights violations are committed by Facebook, Inc.’s product against its users at a psychopolitical level. This analysis finds that Facebook use can lead to international human rights violations, specifically cultural rights, social rights, (...) rights to self-determination, political rights, and the right to health. Mandatory reporting laws, which vary slightly from state to state, require reporting by helping professionals when there is reasonable cause to suspect child abuse. Institutional Review Boards (IRBs) require researchers to warn subjects of this duty to report, which may have a chilling effect on subject rapport and candor. Certificates of confidentiality, in conjunction with other precautions, may reduce some barriers to valid research. Attempts to resolve problems created by reporting laws must produce the most valid research, while minimizing harm (...) and distress to research participants, their families, and the researcher and meeting local and federal legal requirements. Despite the Heideggerian advice to remain silent about silence, this article explores the idea of a fundamental silence at the core of language, an idea that is present in the phenomenological tradition from Husserl to Derrida, but also in other thinkers. The relation between silence, speech, the face and identity is charted, and related to the question what it means to speak a language, and to speak this language rather than that language. The considerations establish the need for a philosophy (...) of communication (in addition to a science of communication) and for an ethics of cautious anticipation regarding language change and linguistic diversity, an ethics which avoids the complicit dangers of (cultural and linguistic) fetishization and instrumentalisation; a multiverse of languages emerges as the only state in which language can exist. In this article, I consider the moment where speech becomes violent because it wants to name at any price - something that can be felt as a desire in speech, a tension of creation and destruction. I discuss Habermas' theory of communicative action and the propositional conception of truth that underpins it. That conception of truth can be contrasted to the theory of truth as event, as it has been developed by Alain Badiou. A similarity between Badiou's theory of truth (...) and the latent utopianism of Adorno's negative dialectics shows that, for contemporary philosophy, the first phase of Frankfurt School theorising remains important. A philosophy that is able to 'motivate and guide the will' (Habermas) needs to include a non-propositional conception of truth; only with a non-propositional conception of truth can we articulate what is involved in communicative violence and come to understand what the place of what cannot be said is, in thought as well as in private, social and political life. The discovery of fragmentary classical sculpture in the fifteenth and sixteenth centuries reorients the making of art toward broken bodies, changing the nature of sculpture as an aesthetic form. But this category shift in the ideal of beauty also makes an opening for the emergence of disability aesthetics: the recognition that the disabled body becomes a valuable resource for the creation and appreciation of new art forms. The idea of disability aesthetics may be traced via disability signposts in which ancient (...) works reminiscent of disability and modern works devoted to disability cross historically to create a powerful line of descent for the emergence of disability as an aesthetic value in itself. Although there is usually agreement about the ethical principles that should govern research on children, there may be little agreement on how those principles should be interpreted into research procedures in some instances. Empirical research on ethical issues that arise in research on children can often elucidate ways to improve on existing research practices and ways to resolve debates about best practices. Following in the success of evidence-based medicine, evidence-based ethical problem solving in human research can enable investigators to avoid (...) such poor alternatives as doing nothing, endlessly debating, or acting on the basis of hunch or time-honored but dubious research practices. A variety of approaches to evidence-based ethical problem solving are illustrated in this article. (shrink)

This article sets out to critically examine the accounts of well-being produced by a middle-aged Swiss woman living in precarious prosperity. By taking on a feminist reading of the narrative on well-being, the article challenges the taken for granted assumption of the powerful agent in thriving societies. Insights from literature on happiness in nations and gender beliefs enabled addressing the woman’s capability to exert agency, while acknowledging the influence of the context in which narratives are embedded. In addition, the presence (...) of a non-national interviewer appears to be an incentive for the interviewee’s compliance with cultural meta-narratives. The approach of well-being as ‘agential flourishing’ proved helpful in assessing the woman’s capability on a gendered career path in atypical employment to deal with precariousness. (shrink)

The sharing of research data is now mandated by some funders to encourage openness and integrity in science, to ensure efficient use of research funds, and to provide training resources. Although data sharing has a long history in some parts of science, the full range of possibilities and challenges it offers are only now becoming apparent in the social sciences. This article (a) examines what may be entailed in sharing documented data, (b) provides a historical perspective on data sharing, (c) (...) describes some of the creative and successful data-sharing relationships that have occurred in the social sciences, and (d) discusses some of the main concerns of social scientists with respect to sharing their data and how these concerns might be resolved. This is an account of the evolution of ideas and the confluence of support and vision that has eventuated in the founding of the Journal of Empirical Research on Human Research Ethics (JERHRE). Many factors have contributed to the creation of this rather atypical academic journal, including a scientific and administrative culture that finally saw the need for it, modern electronic technology, individuals across the world who were committed to somehow finding common ground between researchers and those charged with ethical (...) oversight of research, a network of helpful colleagues, and a university whose administration gave moral support to the endeavor in a time of fiscal austerity. Perhaps equally important were the decisions to make JERHRE a nonprofit undertaking, to emphasize the implications of empirical research for specific best practices, to serve the educational needs of those concerned with human research, and to seek to stimulate the interest of students in gaining an evidence-based understanding of the research contexts in which they decide to work. This article explores the ‘chemistry’ that has made it possible to develop a somewhat unorthodox journal and set of related activities. (shrink)
